1. Who We Are

This website, rubysgifts.com.au (the “Website”), is owned and operated by The Trustee for The Baise Family Trust, trading as Ruby’s Gifts (ABN 65 879 057 742), of Elsternwick, Victoria, Australia (“Ruby’s Gifts”, “we”, “us”, or “our”).

These Terms of Service (“Terms”) govern your access to and use of the Website, including browsing our products and placing orders online. By accessing the Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

2. Use of This Website

You may use the Website for lawful purposes only. You must not:

Use the Website in any way that breaches any applicable law or regulation;
Attempt to gain unauthorised access to the Website, our systems, or any account not belonging to you;
Use any automated system (bots, scrapers, etc.) to access the Website without our prior written consent;
Engage in conduct that restricts or inhibits any other person’s use or enjoyment of the Website.

We reserve the right to restrict or terminate your access to the Website at our discretion, including where we reasonably believe you have breached these Terms.

3. Intellectual Property

All content on the Website — including text, graphics, logos, images, product descriptions, and the overall look and feel — is owned by or licensed to Ruby’s Gifts and is protected by Australian and international copyright, trade mark, and other intellectual property laws. You may not reproduce, distribute, modify, or otherwise exploit any content from the Website without our prior written permission, except for your own personal, non-commercial use in placing an order.

4. Products and Pricing

We make reasonable efforts to ensure that product descriptions, images, and pricing displayed on the Website are accurate and current. However:

Colours and finishes of products may vary slightly from images shown due to display settings, lighting, and the handmade or natural nature of some items;
We reserve the right to correct any pricing or description errors, even after an order has been placed, and will contact you before processing an order affected by such an error;
All prices are displayed in Australian dollars (AUD) and are inclusive of GST unless otherwise stated;
Prices and product availability may change without notice.

5. Orders and Payment

When you place an order through the Website, you are making an offer to purchase the relevant product(s). We reserve the right to accept or decline any order at our discretion — for example, where a product is out of stock, there is a pricing or description error, or we suspect fraudulent activity.

A contract for sale is only formed once we confirm acceptance of your order (typically by way of an order confirmation email or dispatch notice). We accept payment by Visa, Mastercard, American Express, PayPal, AfterPay, and Ruby’s Gifts gift vouchers. Payment is processed securely at checkout, and we do not store your full payment card details.

6. Shipping and Delivery

We aim to dispatch orders within a few business days of receipt. Delivery timeframes are estimates only and are not guaranteed, and may be affected by sale periods, public holidays, or extreme weather events. We do not ship to P.O. boxes or parcel lockers, and only one delivery attempt will be made per order.

It is your responsibility to ensure the delivery address you provide at checkout is complete and correct. Addresses cannot be changed once an order has been processed, and we are not liable for orders delivered to an incorrect address supplied at checkout. Risk in the products passes to you once they are delivered to the address provided.

7. Returns and Refunds

7.1 Our Voluntary Returns Policy

In addition to your rights under the Australian Consumer Law (see clause 7.2 below), we offer a change-of-mind return window of 14 days from the date you receive your order, provided that:

You email us first to request a returns form and confirm the process;
The item is unused, unopened, and in its original, resaleable condition and packaging (including any seal or cellophane wrapping);
You provide proof of purchase (e.g. order confirmation or receipt).

We will inspect returned items on arrival for quality control and hygiene purposes. If an item shows signs of use or is no longer in resaleable condition, it will be sent back to your original shipping address and we will notify you. Where a change-of-mind return is accepted, we will refund the price paid excluding original delivery cost and the cost of returning the item.

If your order arrives damaged or faulty, please email us within 14 days with photos of the issue, and we will assess your claim and arrange a replacement or refund.

Gift cards, vouchers, and credit notes are not eligible for change-of-mind refunds or exchanges.

7.2 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (ACL) or any other applicable law that cannot lawfully be excluded. Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

8. Limitation of Liability

To the maximum extent permitted by law, Ruby’s Gifts excludes all liability for any indirect, incidental, or consequential loss or damage arising from your use of the Website or purchase of products, except to the extent such liability cannot be excluded under the Australian Consumer Law. Nothing in these Terms is intended to limit any rights you may have as a consumer under the ACL that cannot be excluded.

9. Privacy

Our collection and handling of your personal information is governed by our Privacy Policy (also summarised on our FAQ page), which forms part of these Terms.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, legal requirements, or website functionality. The updated Terms will be posted on this page with a revised “last updated” date. Continued use of the Website after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising from these Terms or your use of the Website will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
